Throwing money at scholarships and education incentives dont make people choose a profession they dont like. If they want to be lawyers and doctors and managers, they wont force themselves to go for tech degrees and diplomas just because they get thousands of dollars in scholarships.
People in this country are lucky enough to go for professions they like to do and they would pay money to get it rather than look for discounts on tech degrees.
Even if they do get tech degrees, they wont work in that profession.
So rather than create bogus incentives, why not just impose higher taxes on H1B earning and give that money free to former US citizen computer "Programmers" and cut to the chase rather than create training and education incentives they will never respond to.
This amendment is for placating US citizens computer "Programmers" and "Progammer's" guild.
Well, keep doing that.

Having seen numerous threads in which the exchanges became rude/sarcastic/rude or even outright abusive and vulgar, I was hoping that this would not become one.
Ron, while you may have a point in what you say, sarcasm and taunts will get you no where. As you said, the 'antis' are gearing up, suggesting (I presume) that the effort of all of us should be more concerted and determined. But you are not doing yourself any favor by saying the things that you do.
Raji had a point of view, and has not been rude or offensive in expressing it. In fact, her/his first post was out why it is not good to use the AILA template. Well, PASKAL did try to address. Raji's tone or tenor of posts did not merit a peremptory reply, much less a rude one.
Be that as it may, I do believe fervently that even if someone insists/demands an answer, you can always ignore it instead of being rude or aggressive.

I am no expert on this but if labor substitution is eliminated it will remove anywhere from 30 to 50% of labor cleared from BEC. I know a lot of people who have applied for labor 2 to 3 times, they applied for a new labor every time they went to a new employer. It is these extra labor certifications that are being sold

Finally I am a US citizen after being 10+ years in this country. This is one of my biggest fulfillments and it means everything to me. US is just not home anymore for me, it is my country.

Congrats buddy ! Its quite ironic that there are some people who filed a few months here or there from your PD in 2000/2001 and are still waiting for their GC and I know a few people who filed for GC in 2003/2004 and got it in 2005.
The odds of getting lucky with USCIS are worse than hitting the jackpot .

There is nothing in it for us. In-fact, if this bill passes, they are goin got apply the unused visa numbers towards FB, and we will lose any chance of re-capture, for-ever.
I think, we have a lost cause. The sooner we accept this, the better. We simply do not have the funds, commitment and political support that the illegals enjoy. We all know where the maximum nubver of FB immigrants are from, and they represent a big block of votes, since most of them happen to have the herd mentality, due to lack of education.
We, on the other hand, are educated, well read, tax paying people, who actually think about issues and merits of a person, hence no use to politicians.
Please, could you try and be a bit more positive. 400K illegal to legal or otherwise is a 400K vote if granted residency. Meaning you - a legal, educated and GDP contributor shall have more a chance to those less educated with menial jobs and no real standing on ways of life in this country or a positive contribution to true development. Being positive is half the battle won.

Newer version is - as should've been expected - more protectionist than before.
1) It prohibits H1B workers from working in contract positions.There is a redundant provision for the L1 visa as well (there is already a law which does this for L1). However it doesn't prevent American companies from keeping these contract workers in India or elsewhere and co-ordinate the work through web-conferencing, video conferencing, VPN/VNC etc.
2) It increases H1B fees by another 1000 dollars. There will be the added cost of advertising on DOL website. Also, the legal costs of navigating the audits. It also enables Tort attorneys to sue the companies on behalf of labor unions such as IEEE-USA, PG, Bright Future Jobs, Zazona etc. In essence it makes the whole visa program unviable. American companies cannot participate in the visa program without letting the DOL and the Tort attorneys poking their noses in the daily functioning of Corporate America. Imagine which company will apply for H1B when you'll have ads airing on TV from Tort attorneys - 'Have you been displaced by H1B worker? Call 1-800-TORT-ATTORNEY'?
3) It has a whole gamut of so-called 'H1B/L1B worker protections'. Unless and until the complaining foreign worker's visa status/GC status is protected against employer retaliation, these provisions will remain only on paper, as foreigner workers facing the prospect of forced departure from the country will not complain - extra worker protections or not. They might as well scrap these provisions and save some trees in the process!
4) It retains the provision that H1B/L1 worker must be provided all originals for H1B, Green Card etc. However this will be moot, as there won't be many H1B/L1 workers left in the US to take the benefit. They would already have moved to their home countries, brining the salaries down in their home countries die to excess supply. This combined with technical enablers are going to make outsourcing HOT. I think it's a good time to invest in the stocks of these outsourcing companies. Their returns are going to increase exponentially in a year. I am not surprised, if these companies send a 'Thank You' note to Senators Durbin and Grassley for making such a windfall possible.
If this year only 44,000 visas were used after half a month, wait until this law passes. There will already 10,000 or less visa applications. On a short term basis wages will sky-rocket, when companies are already struggling to make the ends meet. This will definitely make the usage of technological innovations such as the ones mentioned in point 1 more appealing to the companies. In the long run Outsourcing will become cheaper and more attractive.
Faced with accute worker shortage and unreasonably high-salaries driven scarcity in an economy under recession, Companies will have only 3 options. 1) Announce bankruptcy and get out of business salvaging what they can 2) Leverage technology to do outsourcing circumventing the need for visas 3) Beg the government for another 'Stimulus' and more borrowed money from the Chinese to pay the salaries.
This will hit hard the humanitarian immigration for refugees, asylees etc. USCIS is a government department run on visa application fees. As H1B fee-base reduces US government will have to appropriate more funds to USCIS to keep these programs running. The cost of these programmes will increasingly be borne by the American tax-payer. As jobs keep getting outsourced at a much faster speed tax-base formed by these H1B/L1 workers will shift to other economies benefiting them, the government will have to increases the taxes to make up for the difference. No doubt this will increase the tax burden on an average American - even those who had nothing to do with H1B, pro- or against.
The day this law passes will be a great day for Outsourcing, and a sad day for America.

Well, I don't think gctest is against EB3. He is against consultants from sleazy bodyshopping companies, which is right.
A career based on lies and deception is criminal in my humble opinion. There are people who actually came to US with valid experience and education, but still end up applying in EB-3 because the employer did not oblige. Sad for them, but it again boils down to the fact that if the job description qualified them for EB-2, then they got cheated. Otherwise, it is just.
I would like to clear the stand that I am a MS holder from an American university and I work as a Sr. Engineer in one of the top internet firms. I left an offer from that crappy operating system maker because that job did not require MS or even BS+5. It was BS+3. I chose a job where I get to apply in EB2.
People who crib about not getting a chance, even though their job description did not support it are wrong, IMO. NO ONE forced you in to that job. This is not slavery and US is not the only place where you can get a job.

This is real good discussion. I just wanted to know if anyone has travelled using AP multiple times. I just came back from Europe and used AP to reenter. I am still maintaining my H1B status, but I would like to travel to India again in December. I will be using AP again.

Do not tear the GC, instead if you ever receive it and decide going back to India, frame it. One may never in his or her lifetime wait for an entity so much desperately as we all have for the GC.
WillWin, I do not agree that India is not moving forward. Infact people in India are raking money. We should not blame politicians or anyone for the state we are in. No one forced us to leave India. Defending our decision to leave India and come here by calling us "smart" is demeaning to our friends back home. Does it mean that they were not "smart" and hence stayed back? If at all, I would say they were the smartest and are reaping the benefits today.

I know how it feels when guys out there with priority date later than you get approved and you're stuck in this black hole with no clue on what the current status is.
Usually, it takes atleast 7 days for the congressman staff to get any response. It's always better to call the staff casually after couple of days to make sure they have got all the paper work you've sent and they are working on it.
I'm sure your case will be approved soon - have hope.

Imagine if Uncle Sam held an auction to allow you to submit I485 EAD AP, what would you have bid for the right to submit?
Maybe $640, $6,400, or even $64,000?
If Uncle Sam charged a fee to submit now rather than waiting for another year or two or three... What would you have paid to submit I485 and get EAD AP AC21?
Alternatively, how much are you going to benefit from EAD AP or AC21?
AC21 -- maybe ability to move jobs and get a few thousand $ pay rise?
AC21 -- maybe not going to the back of the queue -- really worth thousands!
EAD for you and spouse -- maybe a week of salary for someone that could not previously work?
AP -- how much is it worth not to have to waste time and money renewing H1B at an embassy. That's at least a few days of time you don't have to waste (and time is money).
How much will you save from filing under the old fee structure? At least a few hundreds.
Now use that as a guideline for what you are going to contribute to IV.
