Those who got labor sub and got their GCs already must reapply within XX days or their GCs will be deemed invalid? How do you think will such a rule be?
If labor substitution, applying 140 in 45 days etc.. are the kind of rules that are being framed, it is mainly because all the companies started exploiting these rules.
It can be hypocratically argued that Desi companies only sell labor and misuse it, but from a larger perspective, any company including those multibillion dollar companies may actually misuse labors ie like HR will use sub labor for friend, lawyer may educate HR about the loophole and they will use it as a card for new hires. If such a thing is stopped there is no room for misuse of any form. We have to thank Desi companies because in someway, by totally exploiting the loophole, they helped this cause.
45 days in filing 140. Believe me, such deadline is definitely achievable. 140 is a simple process and all that is needed is company audit and tax reports. I guess time will be given to those who already have labor certified and not applied for 140 for whatever reason.
Such a rule must come even for filing 485. So that companies don't drag that too.

I am not sure if this is true, but I have heard that IRS is now exposing its database to INS, DOL, SSA, DOS, Consulates and DMVs also can participate in it. Any kind of discrepency in salary or status can be exposed by this.
IV iks definitely making a difference. IV has been extremely neutral in all its demands and causes and has raised excellent awareness, I am sure these sites are regularly monitored, which makes a lot of difference.

You may not be able to attend the San Jose rally but you can still be part of the effort by volunteering to help call the members in California and inform them about this event. You can call even if you are on the East Coast. This is urgent!
This will help us focus on other logistic issues like banners, posting flyers.
Your help will make the San Jose peaceful walk a success!

It is completely unpredictable. Actually when you file I485 USCIS does not process FIFO(They are supposed to). For example there are 10k gc are left for the year. First they will process the applications which are cleared FP based on PD and receipt date. Always risk is there when filing without marriage. You are safe till USCIS starts process your application. When they take your application for processing then you cannot add your spouse. Also if CIR decides to process backlogs faster then also you will be in problem. Best option is if your marriage is already fixed do it within 3 months and file GC before PD is backdated. You need not file July first. You can wait till Jul15 to see next VB and decide.
This gives me creeps! 485 applications are NOT processed in FIFO order?!!?!?! I was banking on that being FIFO so I could safely assume that my 485 wont be processed before the next retrogression kicks in in a couple of months -- giving me ample time to get married and bring my wife on H4!! :( :( And I do plan to get married in the next 6-9 months :(

As per our lawyers, right now USCIS is in the process of entering our applications in their system (for date of receipt and such). There was a memo from USCIS saying that they will be done with the job of data entry by August 1.
From August 1, we can expect either rejection or acceptance of the actual application. The hope is that a court/congressional intervention before August 1 will change the USCIS action of rejection into acceptance.

Was the H1B through a body shopper? I"ve heard of reopening all old cases of a company if they find a dubious H1B sponsorship, or if a company gets blacklisted.
If your company is solid and your case is genuine... you probably have nothing to worry about.
The H1B which was approved a year ago and has now been re-opened was not with a body shopper but an US Insurance firm....They had the best of lawyers and company is still going strong....
