The above part of your submission is not true. If you read the I-485 Adjudicator's Manual, you will find that the file is already opened and input into the system at this stage. Otherwise dwhuser would not have received I-797 Notice of Action.
In theory action on a case should be sequenced by priority date and then received date within the priority date batch. However, nobody knows for sure how USCIS works each case.
In the above scenario notice date acts as the receipt date and the received date mentioned on the I 797C is just a mail received date. I just called Customer service and confirmed that a receipt number is issued to an application on the notice date and mentioned on the case status. Hmm...that puts us in a backseat. Although we are officially current on priority date, technically it doesn't apply and we will have to let it pass and wait for... who knows another year :rolleyes:
Also, there is something I wanted to ask I was looking at our I 797C (I485 receipt notice) and found that the Priority date cell is blank. I have checked another I-797 (I-140 approval notice) and it is mentioned there though. Is this common ?

Does one need to be on an F1 (students) visa to get an assistantship?? Can one work only on university campus while doing their assistantship?? If not where is one eligible to work on assistantship & what type of jobs are available?? My wife is planning to do her CPA on an H4 visa, can she work on assistantship while pursuing it??�Please respond.
I am sorry...I do not have too much info abt the H4 visas...Actually I am not sure whether she can do an assistantship on H4 only because it is not a visa on which you can get paid any compensation for work...Isnt the institute where she is doing her CPA sponsoring her F1??

How many of you guys are taking infopass appointments? When you go are you going alone or both applicants (meaning spouses too)...
I'd go to the boston office....and if anyone goes there it'd be nice to know their experience...if it is of no use...I won't make that trip
RD and ND will be a question mark always....but my congressman to whom I had written a pathetic letter came back to me saying my case is in final stages and checks are done waiting for visa number (and I was definitely outside both RD and ND in August last year)...Dunno who to trust .....and then in Oct/Nov I got an RFE so what is the meaning of that....
Problem in contacting the congressman's office right now is that everyone is busy with the healthcare reform and immigration they don't care a rat's add about...

Based on experience from India:
Errors in Passport and Visa entries are problem getting fixed, and if not fixed, can become cause of problem anytime.
The passport issuing office generally can fix typo error in passport as "observation", which they will write in any other page of passport. Getting fixed in any other passport office (which has not issued it) is a lengthy process.
Myself, family of four had got couple of times Passport entries fixed and Visa entries fixed (between 1992 when I was frequent traveller). Typo errors are common. In case of passport errors they fix as "Observation" on the same passport (passport is not changed). In case of Visa errors, they cancel it and give new.
Obviously, once "observation" is noted in passport, you need to show everywhere that the entries are modified

When I said "file is not opened", I meant that no one has yet reviewed the file. Note that for most cases PD is not a controlling factor. It is only the unfortunate ones from retrogressed countries that they have to wait for PD to be current. For everyone else, once file is reviewed, if all documentation is in order, case is cleared. Once a file is reviewed, if it has to wait for PD to be current, it is placed in sequence of PD. See USCIS SOP on the link below, which even tells what color of paper clip to use, etc. (though it is a bit out of date).

your immagination/calculation might be true.....so what?? Havnt we seen a lot of posting about what mischief is being done by a handful?? why do we spend our time on analysing that? IV shouldn't be a website where I log in in the morning and find what all mischief is happening or happened or will happen. There are mischief makers and let the law deal with them. we are a group of straightforward individuals who wish to concenterate on fighting the injustice of the extreme delays. If there was a mischief the USCIS is supposed to catch them and fix it. it is not allowed to delay yours/ mine just because a few others did something wrong. Please concentrate on today and tomorrow. Senthil has articulated legal basis of current system. However, many members feel agrieved by current situation. My displeasure with current law was based on my perception about principles of natural justice and a dogma that one measure (current provisions) should not negatively impact other's basic rights for happiness, equality, nondiscrimination etc. Courts could take a look at how much damage or injury is possible or actually already resulting (stalled careers, family separation, life on hold, creativity-innovation halted) in current system. Atleast it will open up healthy debate and rational measures to address genuine problems.
Could anybody clarify as to whether counting of family members towards annual quota is mandated by congress or it is an administrative provision.
Bill Clinton did a wonderful fix by signing AC21 which corrected many shortfalls of immigration law.
I am personally not impacted by backlog. However, I am feeling bad enough for the failure of current sysem that overlooks human tragedies. 180-day name check fix is a commendable step by USCIS (brought about by healthy debate and do not look at this as court-imposed). As in the scientific world, peer review and criticism is taken seriously in this country. By law suit, we are trying to create peer review or honest analysis about this impasse. No body wins but the truth and humanity.
If there is any way to open up annual quota (recapture, family members exempt from annual limit or any measure I am not aware of), automatically everybody could benefit. It may be also possible for EB3 to interfile or refile for EB2 and take advantage of old priority date and shorten the wait. There is no magic wand! We could help our administrators, law makers, law protectors and law upholders to make appropriate corrections. Hence, scientific and rational dialogue through fair and just means should be our focus.
Let us highlight our difficulties in a logical way. Go about living normal life but stand up for something you believe in.

I am talking about those three to five feet tall cactus plants, that prick you when you touch them.
My message will be:
"Dear USCIS, since the working conditions at USCIS are poor and you may not have resources to water all the flowers that you are receiving. I am sending you a cactus that is low maintenance.

Now I think some major clarifications are needed here. The Receipt Date (RD) that is printed on the I-485 receipt is the date whenever queuing according to RD is needed. This is THE date wherever a FIFO is required and is as assigned as soon as the envelope containing the I-485 is received.
The ND only represents the date data-entry is made. This is the date which is mentioned erroneously as "received date" on the USCIS online system. Now this thing has been mentioned at USCIS liaison meetings by center directors and thro' AILA several times (I will post the reference as soon as I find it).
That said whenever I talked to NSC officers (not the National Customer SC non-officers or regional call center IIO's or Infopass ignoramuses) ..officers who personally were aware of the going on's at the service center they said the Notice date does not carry any value for case adjudication priorities and the CLAIMS 3 systems only sequences (or sweeps as they call it) as per the PD and RD (when needed).
Further, since I see all the notes made for my approved I-485 (thro' FOIA) including the worksheet completed by contractors. I clearly do not see any notations mentioned with reference to the ND on it...
That said, for the OP, since your RD is very close to the "official" processing date there are all chances that your application might have already gone under the eyes of a CAO (Center Adjudication Officer). Call NSC directly and ask since you are so close and especially since your date is going current next month....you want to make sure that your file is either pre-adjudicated OR assigned to an officer.
